Welcome to the Kore Labs Benchmark App. By accessing or using our application and services, you ("the Client" or "User") agree to be bound by these Terms of Service. Please read them carefully.

1. Description of Service

Kore Labs provides a Business Intelligence and Lifecycle Marketing Operating System. Our services include:

• Analytics & BI: Transformation of raw data into actionable insights regarding margins (CM2), stock optimization, and Profit on Ad Spend (POAS).

• Email Lifecycle Marketing: Implementation of automated flows including welcome series, abandoned carts, and predictive replenishment.

• Benchmarking: Anonymized comparison of your store's performance against industry standards.

2. The "No Automatic Optimization" Rule

Kore Labs operates as a consultative and analytical tool. Our app does not perform automatic optimizations or unauthorized changes to your Meta Ads, Shopify, or Tiendanube accounts.

• All recommendations provided by the system require human review and manual execution by the Client or a designated Kore Labs strategist.

• The system is designed to identify "gaps" and "leaks," but final execution remains under the Client's control.

3. Intellectual Property

All algorithms, custom properties (e.g., Kore_LTV_Tier, Kore_Churn_Risk), and proprietary models such as the Inventory Tension Algorithm and POAS Engine are the exclusive intellectual property of Kore Labs.

• Users are granted a non-exclusive, non-transferable license to use the insights generated during the term of their subscription.

4. Data Usage and Confidentiality

• Data Ownership: You retain all rights to your raw business data.

• Benchmarking: By using the app, you grant Kore Labs the right to use your data in an anonymized and aggregated format to improve our industry benchmarks. Your specific brand identity will never be revealed in these benchmarks.

• Security: We implement industry-standard protocols to ensure your financial and customer data remains secure and confidential.

5. Limitation of Liability

Kore Labs acts as a Performance Partner. While we strive for maximum accuracy in our reporting and forecasting (e.g., Cashflow and Forecast modules), we do not guarantee specific financial results.

• Kore Labs is not liable for any business losses resulting from decisions made based on the app’s data, inventory stock-outs, or changes in third-party platform algorithms (Meta, Google, Shopify).

6. Subscription and Termination

• Services are provided based on the selected tier (CORE, Strategic Growth, or Market Leader).

• Either party may terminate the service according to the specific terms outlined in the individual Commercial Proposal.

• Upon termination, access to the Kore Labs Dashboards will be revoked, and data will be handled according to our Privacy Policy.

7. Modifications to Terms

We reserve the right to modify these terms at any time. Continued use of the app after such changes constitutes acceptance of the new terms.
